trainer.do

Terms of Service for coaches

Version 1.0 · Effective October 29, 2026

Summary in 30 seconds

You are subscribing to software. The free trial requires a card and is charged automatically when it ends unless you cancel first; the subscription renews automatically until you cancel. You are the professional responsible for your services and your clients’ data; we only provide the tool. No warranties beyond what the law requires, and limited liability.

The summary is a guide; the full text below is what applies.

1. The agreement and who is bound

trainer.do is a service operated by Digital Motion Labs, LLC, a limited liability company organized in United States (Delaware) (“trainer.do”, “we”, “us”).

These Terms govern your use of trainer.do as a coach (trainer, nutritionist or other professional who uses trainer.do to serve their clients). By ticking the acceptance box and creating your account, you enter into a contract with Digital Motion Labs, LLC. You contract as a professional or business, not as a consumer. If you accept on behalf of a company, you represent that you have authority to bind it. You must be 18 or older.

The following form part of this agreement: the Data Processing Agreement (DPA), the Acceptable Use Policy, the Cancellation and refund policy, the Health notice and the Privacy Policy.

2. What the service is (and is not)

  • trainer.do is software to manage training and nutrition plans, follow-up, chat, appointments, payments and a shop with your clients.
  • trainer.do does not provide training, nutrition, medical or health services. You provide those services, under your sole professional responsibility.
  • trainer.do does not provide medical advice and is not a medical device (see the Health notice).
  • You are an independent professional: you are not an employee, agent, partner or representative of Digital Motion Labs, LLC, and you may not present yourself as such. We do not verify your degrees, licenses or certifications unless we expressly say so.

3. Your account

  • Give truthful information and keep it up to date. Your account has an email verified with a code; you sign in with codes sent to that email or, if you added and verified your number in My account, via WhatsApp: protect access to them.
  • You are responsible for what happens in your account and for the people you give access to. Tell us immediately if you suspect unauthorized access.

4. Plans, prices and free trial with card

  • We offer plans (for example Starter, Pro and Studio) billed monthly or yearly. Price, currency, applicable taxes and what each plan includes are shown before you pay.
  • Free trial: when offered (usually 14 days), it requires a card. When the trial ends the plan and billing period you chose are charged automatically, unless you cancel before it ends. The date and amount of the first charge are shown next to the payment button. If you cancel during the trial, you are not charged.
  • Pay now: you can also pay from day one without a trial.
  • Automatic renewal: the subscription renews automatically at the end of each period (month or year) and is charged to the card on file until you cancel.
  • Coupons: a coupon applies only under its conditions (plan, duration, number of uses), has no cash value and may expire.
  • Price changes: we will notify you at least 30 days in advance; the new price applies from your next period and you can cancel before it if you disagree.
  • Purchased AI credits do not expire, are not transferable and are not refunded except as provided in the refund policy.

5. Cancellation and refunds

You can cancel at any time from “My subscription”, without penalty. You keep access until the end of the period already paid and you are not charged again. Paid periods are not refunded, except for our error, duplicate charges, a serious service outage attributable to us or where the law requires it. Details in the Cancellation and refund policy.

6. Failed payments, grace and suspension

If a charge fails we will notify you and there will be a grace period to fix it. If it remains unpaid, your coach account is suspended until payment: nothing is deleted and, once paid, it is reactivated. While suspended, your clients keep the free basic version of the app but not your content.

7. Payments with Stripe

Card payments are processed by Stripe. By paying you also accept the Stripe terms that apply to you as a payer. We never see or store your full card number. If in the future we let you charge your own clients by card, you will also have to accept Stripe’s connected account agreement; today your clients pay you directly through the payment methods you set up (bank transfer, cash, PayPal, payment links…) and the app only shows them those details and helps you record the payments: we do not process, receive or guarantee those payments. Do not store card numbers in the app.

8. Your obligations as a professional

  • Hold and maintain the qualifications, licenses, permits and, where applicable, the professional liability insurance your activity requires.
  • Assess each client before prescribing exercise or diet, adapt the plan to their health, allergies and injuries, and recommend they see a doctor when prudent.
  • Not diagnose or treat diseases, not promise cures or guaranteed results, and not recommend medication or banned substances.
  • Invite only people who want to be your clients and obtain their explicit consent to process their health data (the app asks for it in the questionnaire), complying with the DPA. Invitations are sent by email: you do not create accounts on behalf of others; each person creates their own when accepting, verifying their own email with a code.
  • Not serve minors under 18 through the app.
  • Comply with the law applicable to your activity, advertising, prices and the taxes on what you charge your clients. Your commercial relationship with your clients (prices, refunds, warranties, products in your shop) is between you and them.

9. Personal data

Regarding your clients’ data, you are the controller and Digital Motion Labs, LLC is the processor, under the DPA, which you accept together with these Terms. We process your own account data as controller under the Privacy Policy.

10. Intellectual property and content

  • The software, the trainer.do brand, the design and the documentation belong to Digital Motion Labs, LLC or its licensors. We grant you a limited, non-exclusive, non-transferable license to use them while your subscription is active.
  • Your content (plans, programs, protocols, templates, brand and logo) is yours. You grant us a limited license to host, process, display it to your clients and back it up, only to provide the service.
  • You represent that you have the right to upload what you upload (images, videos, PDFs) and that it does not infringe third-party rights.
  • If you give us suggestions, we may use them without obligation to you.

11. Artificial intelligence

AI features (meal-photo analysis, PDF reading) deliver estimates that may be wrong. You must review them before using them in a plan; the final decision and its responsibility are yours. They only run with explicit consent.

12. Availability and changes to the service

We aim to keep the service available, but there may be outages, maintenance or provider failures. We may improve, change or remove features; if we remove an essential feature of your plan we will give reasonable notice and you may cancel. Features marked “beta” are offered as is.

13. Suspension and termination

  • You may stop using the service and cancel at any time. You can also deactivate your account: nothing is deleted and it can be restored.
  • We may suspend or terminate your account for non-payment, breach of these Terms, the DPA or the Acceptable Use Policy, risk to users or to the platform, or a legal order. Unless urgent or legally prohibited, we will notify you first and give you a chance to fix it.
  • On termination, you may ask us to export your data and your clients’ data and then delete it, under the DPA.

No warranties

To the extent permitted by law, trainer.do is provided “as is” and “as available”, without warranties that it will be uninterrupted, error-free or fit for a particular purpose, nor of any physical, athletic, aesthetic or health results. trainer.do is not a medical device.

Limitation of liability

To the maximum extent permitted by law: (a) Digital Motion Labs, LLC is not liable for indirect, incidental, special or consequential damages, lost profits, loss of clients, reputation or data; (b) it is not liable for the services, advice, plans or conduct of any coach (including you) nor for injuries or damages arising from them; and (c) its total liability for any claim related to the service is limited to what you paid us in the 12 months before the event giving rise to it. These limitations do not apply to fraud, gross negligence or anything the law does not allow to be limited.

Indemnity

You agree to defend, indemnify and hold harmless Digital Motion Labs, LLC, its members, officers and employees from third-party claims, damages, fines and reasonable expenses (including attorneys’ fees) —including from your clients and authorities— arising from: (a) your professional services, plans, advice or products; (b) the content you upload; (c) your breach of these Terms, the DPA or the law (including data protection law); or (d) your clients’ lack of consent for the processing of their data.

Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. Before bringing a claim, the parties will try in good faith to resolve the dispute for 30 days after written notice. If not resolved, it will be submitted to the state or federal courts located in the State of Delaware, United States, whose jurisdiction you accept; the parties may agree in writing to arbitration instead. Either party may seek urgent relief before a competent court.

Nothing above limits non-waivable rights granted to you by the law of your country (for example, Dominican Law 358-05 on Consumer Protection, if applicable to you).

Assignment and successors

Digital Motion Labs, LLC may assign or transfer these Terms and the related data, with notice to you, to an affiliate or a successor, including upon conversion into another entity form (for example, from an LLC into a Delaware corporation), merger, reorganization or sale of the service; the successor will be bound by these Terms and the Privacy Policy. You may not assign them without our written consent.

Changes to these Terms

Each version has a number and a date (see the Legal center). If a change affects your rights or obligations (major version), we will ask you to accept it expressly in the app before continuing to use it; if you do not accept it, you may cancel and it will not apply to your already-paid period. Minor changes (wording, clarifications) are notified to you and apply from publication.

Notices and electronic acceptance

We will notify you in the app, at your account email or, if you verified it, on your WhatsApp. You may notify us at [email protected] or in writing at 1111B South Governors Avenue, STE 40566, Dover, DE 19904, United States. You agree that your electronic acceptance (checkboxes, buttons) and the records we keep of it are fully valid, under Dominican Law 126-02 and the US E-SIGN Act.

Miscellaneous

  • If a clause is held invalid, the rest remains in force.
  • Failure to exercise a right is not a waiver of it.
  • Neither party is liable for failures caused by force majeure (disasters, widespread internet or power outages, acts of authority, serious provider failures).
  • This document, together with those it incorporates, is the entire agreement on its subject. If the Spanish version and the English translation differ, the Spanish version prevails.
